Algorum Software Private Limited (“Algorum,” “we,” “us,” or “our”) welcomes you. Our Services are subject to the following privacy policy (the “Privacy Policy”), which may be updated by us from time to time without notice to you.  This Privacy Policy sets out the manner in which personal information and sensitive personal data or information or other categories of data (if any) is collected, received, possessed, used, stored, processed, disclosed, transferred, dealt with and handled by Algorum in relation to your access and use of the Services. By accepting this Privacy Policy, accessing or using the Services, or otherwise manifesting your assent to this Privacy Policy, you agree to be bound by this Privacy Policy and the accompanying Terms of Service, which together make up the Agreement. If you do not agree to (or cannot comply with) all of the terms of this Privacy Policy or any other terms of the Agreement, you may not access or use the Services.

 

By accepting the Privacy Policy or accessing or using the Services, you represent and warrant that: (a) you are legally competent to contract; (b) you are not subject to any law or agreement that would be breached by your accepting the Privacy Policy or using the Services or performing your obligations under the Privacy Policy; and (c) you will at all times during the subsistence of the Agreement comply with all applicable laws and regulations. If you accept or agree to this Agreement on behalf of a company or other legal entity, you represent and warrant that (i) you have the authority to bind that company or other legal entity to the Agreement; and (ii) upon acceptance by you, the Privacy Policy is applicable to and binds all other persons accessing or using the Services on behalf of the same company or legal entity, and, in such event, “you” and “your” will refer and apply to that company or other legal entity.  This Privacy Policy does not apply to information that you provide to, or that is collected by any third-party that You integrate or use in connection with the Services. Please read the Privacy Policy carefully before accessing, using or, to the extent applicable, registering on our Services.

THE INFORMATION WE COLLECT AND HOW WE USE IT

 

In the course of operating the Services, Algorum collects or receives the following types of information, which may include personal information.

Contact Information

We collect contact information through our Services; contact information typically includes your name, email address, country, and any information you provide in messages to us. We use such contact information for purposes such as registering you for an account, providing you with information about the Services, responding to your inquiries, sending you email alerts (including marketing emails), or providing you the Services.

 

Payment Information

To process your payments for trades you make through the Platform, we require that you provide our third party payment processor or vendors, certain billing information, which may include your credit card number, expiration date, bank account information, billing address, activation code, and similar information (collectively, “Payment Information”). The manner in which your Payment Information is collected, received, stored, processed, disclosed, transferred, dealt with and handled by such third parties is governed by the terms and conditions and privacy policy of the respective third party.  Algorum urges you to acquaint yourself with the terms and conditions and privacy policy of every such third parties. You authorize our third party payment vendors to collect, process, and store your Payment Information in accordance with their respective privacy policies.  We reserve the right to change our payment vendors at any time, or to use additional payment vendors, at our discretion, and will update this Privacy Policy from time to time accordingly. You play an important role in keeping your personal information secure.

 

Server Log Information

Our servers keep log files that record data each time a device accesses those servers. The log files contain data about the nature of such access, including the device’s IP address, user agent string (e.g., operating system and browser type/version), and the pages you’ve clicked on while on our Services, and details regarding your activity on the Services such as time spent on the Services and other performance and usage data. We may use these log files for purposes such as assisting in monitoring and troubleshooting errors and incidents, analyzing traffic, or optimizing or customizing the user experience.

  • Session Cookies: We use session cookies to make it easier for you to navigate our Services. A session ID cookie expires when you close the Services.

To the extent we provide a log-in portal or related feature on our Services, persistent cookies can be used to store your passwords so that you don’t have to enter it more than once.  Additionally, persistent cookies enable us to track and target the interests of our Visitors and Users to personalize the experience of our Services.

Aggregate Data

 

In an ongoing effort to better understand our Visitors to the Website, Users, and the Services, we might analyze your information in aggregate form to operate, maintain, manage, and improve the Services. This aggregate information does not identify you personally. We may share this aggregate and de-identified data with service providers, and our affiliates, agents, and business partners. We may also disclose aggregated user statistics to describe the Services to current and prospective business partners and to other third parties for other lawful purposes.

 

Onward Transfer to Third Parties

 

  • Like many businesses, we hire other companies to perform certain business-related services. We may disclose personal information to certain types of third party companies but only to the extent needed to enable them to provide such services. The types of companies that may receive personal information and their functions are: hosting services, technical assistance, database management/back-up services, use analytics, email marketing platforms, and customer service.

 

  • We may disclose information to the Brokerage Partner with which you hold an account as necessary to deploy your trade strategies.

 

  • We may also disclose personal information to our parent companies, subsidiaries, affiliates, joint ventures, or other companies under common control to support the marketing and sale of the Services.

 

Service Provider Transfers

 

In the event of a merger, dissolution, reorganization or similar corporate event, or the sale of all or substantially all of our assets, we expect that the information that we have collected, including personal information, would be transferred to the surviving entity in a merger or the acquiring entity. All such transfers shall be subject to our commitments with respect to the privacy and confidentiality of such personal information as set forth in this Privacy Policy. This policy shall be binding upon Algorum and its legal successors in interest.

 

Disclosure to Public Authorities

We are required to disclose personal information in response to lawful requests by public authorities, including for the purpose of meeting national security or law enforcement requirements. We may also disclose personal information to other third parties when compelled to do so by government authorities or required by law or regulation including, but not limited to, in response to court orders, notices, and subpoenas or to protect the safety of Algorum, including its employees, representatives, agents, Users, or any person, in an emergency. 

 

OPT-OUT FOR DIRECT MARKETING; EMAIL MANAGEMENT

 

You may opt out at any time from the use of your personal information for direct marketing purposes by emailing the instructions to support@algorum.in or by clicking on the “Unsubscribe” link located on the bottom of any Algorum marketing email and following the instructions found on the page to which the link takes you. Please allow us a reasonable time to process your request. You cannot opt out of receiving transactional or administrative e-mails related to the Services.

 

HOW WE PROTECT YOUR INFORMATION

 

Algorum takes very seriously the security and privacy of the personal information that it collects pursuant to this Privacy Policy. Accordingly, we implement reasonable security measures designed to protect your personal information from loss, misuse and unauthorized access, disclosure, alteration and destruction, taking into account the risks involved in processing and the nature of such data, and to comply with applicable laws and regulations.  Please understand, however, that no security system is impenetrable.  We cannot guarantee the security of our databases or the databases of the third parties with which we may share your information (as permitted herein), nor can we guarantee that the information you supply will not be intercepted while being transmitted over the Internet.  In particular e-mail sent to us may not be secure, and you should therefore take special care in deciding what information you send to us via e-mail.

 

CHILDREN

 

We do not knowingly collect personal information from persons under the age of 18 through the Services. If you are under 18, please do not give us any personal information.  We encourage parents and legal guardians to monitor their children’s internet usage and to help enforce our Privacy Policy by instructing their children to never provide personal information.  If you have reason to believe that a child under the age of 18 has provided personal information to us, please contact us at support@algorum.in, and we will endeavour to delete that information from our databases.

 

IMPORTANT NOTICE REGARDING OUR SERVICES

 

Our servers are located in the United States and elsewhere.  Please be aware that your information may be transferred to, processed, maintained, and used on computers, servers, and systems located outside of your state, province, country, or other governmental jurisdiction from where you reside. We may store your personal information (or any portion thereof) locally in order to comply with requirements under specific local laws and regulations which may be applicable to us.

 

DATA RETENTION

 

We will retain the personal information that you provide to us or that we collect about you for so long as necessary to provide the Services, until necessary in relation to the purposes for which such personal information was collected, as necessary to resolve disputes, enforce our agreements, and as required under applicable law. We may further retain personal information in a de-identified or aggregated form where this information will not identify you personally.

 

CONSENT

 

You may choose to not provide your consent or withdraw your consent to this Privacy Policy at any point in time. The withdrawal of the consent must be notified to Algorum in writing to support@algorum.in. In case you do not provide your consent or later withdraw your consent, we request you not to access the Platform, content and use Services and we also reserve the right to not provide you any Services and/or content on the Platform. In such a scenario, Algorum may delete your information (personal or otherwise) or de-identify it so that it is anonymous and not attributable to you.

 

DO NOT TRACK

 

Algorum does not respond to “Do Not Track” settings or other related mechanisms at this time.

 

LINKS TO EXTERNAL WEBSITES

 

The Services may contain links to third-party websites (“External Sites”) which may collect your personal information. These External Sites may have their own privacy policies governing the storage, processing, and retention of your information that you may be subject to. This Privacy Policy does not govern any information provided to, stored on, or used by these External Sites. Algorum has no control over the privacy practices or the content of any such External Sites.  As such, we are not responsible for the content or the privacy policies of such External Sites or the security of your information shared with them. We recommend that you check the applicable privacy policy and terms of service when visiting any such External Sites as it relates to safeguarding of your information.

 

CHANGES TO THIS PRIVACY POLICY

 

This Privacy Policy is effective as of the last updated date stated at the top of this Privacy Policy.  We may change this Privacy Policy from time to time with or without notice to you. By accepting the amended Privacy Policy or accessing the Services after we make any such changes to this Privacy Policy, you are bound by such changes.  Please be aware that, to the extent permitted by applicable law, our use of the information collected is governed by the Privacy Policy in effect at the time we collect the information.  Please refer back to this Privacy Policy on a regular basis.

YOUR ACKNOWLEDGEMENT AND TRANSPERANCY

No liability pertaining to the authenticity/ genuineness/ misrepresentation/ fraud/ negligence, etc. of the information disclosed shall lie on Algorum nor will Algorum in any way be responsible to verify any information obtained from you.

 

You shall ensure and confirm that any information provided by you to Algorum is complete, accurate and up to date. If there is any change in the information or if any information is found to be incomplete, inaccurate, or incorrect, you shall promptly update your information on the Platform or request Algorum for information revision or update. If you provide any data that is untrue, inaccurate, not current or incomplete (or becomes untrue, inaccurate, not current or incomplete), or if Algorum has reasonable grounds to suspect that such data is untrue, inaccurate, not current or incomplete, Algorum has the right to suspend or terminate your account and refuse any and all current or future use of the Services, in addition to any right that Algorum may have against you at law or in equity, for any misrepresentation of information provided by you.

 

GRIEVANCES

 

In the event you have any grievances relating to the Privacy Policy, please inform Algorum the instance of the grievance, by writing an email to the designated officer at support@algorum.in.
